New Labour Agreement for Aged Care Sector (May 5, 2023)

A new Labour Agreement for the Aged Care Industry was announced this morning, Friday 5th May 2023, by Minister Giles, offering migrants a faster pathway to permanent residency.

The Labour Agreement for the Aged Care Sector is available immediately.

The Agreement entitles the eligible sponsor to sponsor overseas care workers for a period of up to four (4) years on a temporary basis or for permanent residence after two (2) years of employment with the Australian employer.

The potential sponsor will need to enter into a Memorandum of Understanding (MoU) with one of the relevant industry union to access the labour agreement.

There are three occupations listed under this Industry Labour Agreement and they are:

  • Nursing Support Worker (ANZSCO 423312)
  • Personal Care Assistant (ANZSCO 423313)
  • Aged or Disabled Carer (ANZSCO 423111)

The visa applicants have access to concessions to English language skills, qualification and employment experience and offered salary.

English skills

If applicants are employed by standard care providers, IELTS 5.0 or equivalent with minimum 5.0 for speaking and listening and 4.5 for reading and writing;

If applicants are employed by culturally and linguistically diverse aged care providers, IELTS 4.5 or equivalent with no component minimum, so long as the overseas worker is fluent in the target community language
IELTS 5.5 or equivalent with no component minimum for 186 visa applications.

Qualifications

For TSS 482 visa, AQF Certificate III or equivalent or higher or 12 months of relevant full time work experience or part time equivalent.

For ENS 186 visa, applicants must have at least AQF Cert III or equivalent qualification.

Positive skills assessment required for certain applicants

If applicants obtained qualifications overseas or claiming work experience in lieu of a relevant qualification, a positive skills assessment is requirement from either:

  • Australian Nursing and Midwifery Accreditation Council (for Nursing Support Worker ANZSCO 423312 or Personal Care Assistant ANZSCO 423313); or
  • The Australian Community Workers Association (for Aged or Disabled Carer ANZSCO 423111)

Employment experience

For TSS 482 visa, there is no minimum level of post qualification work experience required;

For ENS 186 visa, at least two years full time work experience in Australia. The two years’ work experience is not required to be tied to a particular employer or visa subclass.

Salary

Minimum $51,222

Age

Can be any age for TSS 482 visa but need to be under 45 for ENS 186 visa.

The sponsor is deemed to satisfy the labour market testing requirements once an MoU is entered with the relevant industry union (s).

In addition, the Agreements – which will be made available to providers immediately – and their associated visa applications will be processed by the Department of Home Affairs as a matter or priority.
